Terms of Use

These Terms of Use (“Terms”) govern your use of the services provided on this website, konbiniDB(the “Site”). By using our services (the “Service”), you, the user (“User”), agree to be bound by these Terms.

Article 1 (Application)

These Terms shall apply to all aspects of the relationship between the User and the Site concerning the use of the Service.

Article 2 (User Registration)

  1. To use certain features of the Service, such as posting reviews, User registration may be required.
  2. Registration is completed when a prospective User applies for registration according to the method specified by the Site, and the Site approves the application.
  3. The Site may reject a registration application if it determines that the applicant:
    • Has provided false information in the application.
    • Has previously violated these Terms.
    • Is otherwise deemed unsuitable for registration by the Site.
    The Site is not obligated to disclose the reasons for rejection.

Article 3 (Management of User ID and Password)

  1. The User is solely responsible for the proper management of their User ID and password for the Service.
  2. Under no circumstances may the User transfer or lend their User ID and password to a third party.
  3. The Site shall not be liable for any damages resulting from the use of a User’s ID and password by a third party, except in cases of willful misconduct or gross negligence on the part of the Site.

Article 4 (Prohibited Activities)

In using the Service, the User shall not engage in any of the following activities:

  • Acts that violate laws or public order and morals.
  • Acts related to criminal activity.
  • Acts that destroy or interfere with the functionality of the Site’s, other Users’, or third parties’ servers or networks.
  • Acts that may interfere with the operation of the Site’s services.
  • Collecting or storing personal information about other Users.
  • Unauthorized access or attempts thereof.
  • Impersonating other Users.
  • Providing benefits, directly or indirectly, to anti-social forces in connection with the Site’s services.
  • Infringing on the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Site, other Users, or third parties.
  • Posting content that is excessively violent, sexually explicit, discriminatory (based on race, nationality, creed, gender, social status, etc.), or content that induces or promotes suicide, self-harm, or drug abuse, or any other anti-social content that causes discomfort to others.
  • Acts for the purpose of business, advertising, promotion, solicitation, or other commercial purposes (except as approved by the Site).
  • Acts intended to slander or defame specific individuals or stores.
  • Any other acts deemed inappropriate by the Site.

Article 5 (Posted Content)

  1. The User represents and warrants that they have the legal right to post or transmit the reviews, images, and other content (“Posted Content”) they submit, and that the Posted Content does not infringe upon the rights of any third party.
  2. While the User retains copyright to their Posted Content, by using the Service, the User grants the Site a worldwide, non-exclusive, royalty-free license to use (including to reproduce, edit, publish, create derivative works from, and distribute) the Posted Content for the purposes of providing, promoting, and improving the Service, and developing new services. This license continues even after the User deletes their account.
  3. The Site may, without prior notice to the User, delete or hide any Posted Content that it deems to be in violation of these Terms.

Article 6 (Disclaimer of Warranties and Limitation of Liability)

  1. The Site does not warrant, either expressly or implicitly, that the Service is free from defects (including, but not limited to, defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, errors, bugs, or infringement of rights).
  2. The Site shall not be liable for any damages incurred by the User arising from the Service, except in cases of willful misconduct or gross negligence on the part of the Site.
  3. The Site assumes no responsibility for any transactions, communications, or disputes that may arise between the User and other Users or third parties in connection with the Service.

Article 7 (Changes to Service Content)

The Site may, with prior notice to the User, change, add to, or discontinue the Service, and the User agrees to these terms.

Article 8 (Changes to Terms of Use)

The Site reserves the right to modify these Terms at any time without notifying the User, if deemed necessary. The User’s continued use of the Service after any changes to the Terms will be considered acceptance of the revised Terms.

Article 9 (Privacy Policy)

The handling of Users’ personal information by the Site shall be governed by a separately established Privacy Policy, and the User agrees that the Site will handle their personal information in accordance with this Privacy Policy.

Article 10 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court that has jurisdiction over the location of the Site’s operator.
